Terms and conditions of sale and use
Version of 1 October 2026. They apply to every order placed on maisonfloruit.com from that date.
These terms are written to be read. They are the contract between you and us. If a sentence is not clear, write to us before ordering: nissielthomas@avafirstai.com.
1. Who we are
The Maison Floruit service is provided by AVA FIRST AI, a société par actions simplifiée (simplified joint-stock company under French law), 173 rue de Courcelles, 75017 Paris, SIREN 104 044 201, registered with the French National Business Register on 24 April 2026 (hereafter "we" or "us").

2. The words we use
- The family contact (in French, "la référente"): the person who signs up, chooses the package, pays, and is the point of contact for the whole service. She is the one who accepts these terms. We write "you".
- The author: the elderly person Jeanne calls, whose memories make up the book. The word is feminine in the French original because that is the most common case; it applies equally to a man.
- The relatives: the family members the family contact invites into the family space.
- Jeanne: the voice assistant who makes the calls. She is a computer program.
- The book: the story composed from the author's words, delivered as a PDF file or as a printed book depending on the package.
- The family space: the part of the website reserved for the family contact and the invited relatives.
3. Purpose of the contract
We undertake to:
- call the author every week, at the agreed time, for the duration of the package;
- record and transcribe these conversations, with her agreement;
- send the family, after each call, a clip that the author has agreed to share;
- compose, from her words alone, a book that she reads before anyone else;
- deliver this book in the format ordered, together with the recordings.
You undertake to pay the price and to meet the obligations in section 10.
4. What the service is, and what it is not
Jeanne is a computer program. She says so at the start of every call. If the author asks whether she is a real person, she says no.
Members of our team listen to the calls, afterwards, never live, to check that the call went well and that the clip can be sent. The author knows this from the first call.
The book contains only what the author said. Her sentences are transcribed and put in order. Nothing is added, nothing is embellished. When a name or a date is doubtful, the doubt is flagged to the family; it is not settled on her behalf.
It is not a telecare service. It is neither a medical service, nor an emergency service, nor a monitoring device. We do not detect falls, faintness or abnormal silences, and we do not promise to. If the author says during a call that she is in pain, that she has fallen, or says something worrying, we notify the family contact by text message and then by telephone, as soon as possible, with no guaranteed timeframe. For an emergency, call 999 or 112 (in France: 15, 18 or 112).
Jeanne gives no advice, medical, legal or financial. She never asks for money, a code or a card number. She takes no sides in a family story.
Jeanne is not a friend and does not claim to be. She does not say "I love you". She encourages the author to call her family.
5. Conditions for signing up
- The family contact is an adult and is acting for herself, not for a business.
- The author is an adult.
- The author has been told about Jeanne's calls before the first call, and knows that Jeanne is a program (section 10).
- If the author is under guardianship (tutelle), a deputyship (curatelle), a family authorisation (habilitation familiale) or any other protective measure, you declare it when signing up. The written agreement of the person in charge of the measure is then requested before the first call, in addition to the author's own agreement. We may refuse or postpone the order if we consider that the service does not suit her situation.
- The author is able to hold a conversation on the telephone. If she is hard of hearing, the service can be adapted (speakerphone, slower pace); if it remains impossible to understand each other, we stop and refund the calls not made.
6. The free trial
The trial comprises two calls from Jeanne and a PDF file containing the beginning of the book. It is free and requires no bank card. It commits you to nothing.
The first call takes place with the family contact present with the author, or having told her just beforehand. The second call takes place with the author on her own. Jeanne asks for her agreement on the first call and asks again on the second (section 9).
At the end of the trial, you choose to continue with a paid package, or to stop. If you stop, or if you do not reply, no further call is made. The recordings are kept and then deleted in accordance with the privacy policy, and you can ask for their deletion at any time.
One trial per author.
7. Packages and prices
Prices are in euros, inclusive of all taxes. They are those shown on the website at the time of ordering. The prices below are given for information; in the event of a discrepancy, the price shown on the order page prevails.

The 24 calls are planned over about six months. The pace may be doubled (two calls a week, book in about four months) if the family asks for it or if the author's state of health warrants it. The number of calls stays the same.
Delivery of the hardback book and the printed items is included in the price for metropolitan France. For any other destination, write to us before ordering.
The two trial calls are not deducted from the 24 calls of the package.
8. Ordering and payment
The order is placed on the website, after the trial. You choose the package, you read the summary, you accept these terms by ticking the box provided, then you pay.
Payment is made in one instalment, by bank card, through Stripe. We neither see nor keep your card number. The "Jeanne carries on" subscription is charged every month, by the same means.
The order is confirmed by e-mail. Paid calls begin at the usual time slot following the confirmation.
Invoices are available in the family space.
If a payment fails or is disputed, the calls are suspended until the matter is put right.
9. The author's agreement
The service cannot exist without the author's agreement. That agreement is separate from yours.
- On the first call, Jeanne introduces herself as a program, says the word chosen with the family, explains that she records in order to write the book, that members of the team listen, that the family will only hear what the author agrees to, that she can have anything she wants erased and can stop whenever she wants. She asks for her agreement. The author must say yes clearly. Otherwise, Jeanne thanks her and hangs up, and nobody calls again unless you ask us to.
- On the second call, the author is on her own. Jeanne checks that she has understood what the two of them do together and asks for her agreement again.
- On every subsequent call, Jeanne reminds her that she is recording.
- At any time, the author can say "that stays between us" or "take that out". The passage is neither written down, nor passed on to the family, nor kept. She can also say that she no longer wishes to continue: the calls stop.
- Before every clip sent to the family, Jeanne tells her what she would like to let them hear and asks whether that is all right. If she says no, nothing is sent.
The author's agreement is recorded, with the date and her words, so that we can prove it was given.
If the author withdraws her agreement, the contract ends and you are refunded for the remaining calls (section 13). You cannot override her refusal, and neither can we.
10. Your obligations
By accepting these terms, you undertake to:
- tell the author before the first call: that a computer program called Jeanne is going to call her, to write a book of her memories, that the conversations are recorded and listened to by the team, and that she can stop whenever she wants. We give you a one-page guide to do so;
- be present, or have told her just beforehand, for the first call;
- give the right telephone number for the author, and a number where you can be reached during the call slots. We only call the number you give us. If that number is not the author's, you bear the responsibility;
- declare any protective measure (guardianship, deputyship, family authorisation) when signing up, and tell us of any change during the service;
- tell us about any diagnosed memory condition, loss of hearing, hospital stay, or any fact that changes the author's situation;
- respect her choices: you cannot remove a passage from the book without her agreement, nor rewrite her sentences. You correct names, dates and captions, and you write in the margin, signing your notes;
- respect the people mentioned: the book and the recordings are intended for private use, within the family circle. You do not publish them, sell them, or distribute them on the internet or on social media. You do not use them against a person mentioned. If a passage implicates a living person, we may remove it or anonymise it before printing, and we tell you so;
- not pass on your access: the codes received by text message and the links to the family space are personal. You invite relatives through the website, not by sharing your codes;
- not use the service to monitor the author, to obtain information from her about her money, her inheritance or her papers, or to influence her. Questions suggested by the family go through our team, which may set them aside;
- provide photographs and texts you have the right to use for family purposes.
Invited relatives accept these terms when they enter the family space. You are answerable for their compliance with these rules.
If you are present during a call and you speak, your voice is recorded too. By accepting these terms, you accept this.
11. How the service runs
- The calls take place at the time slot agreed with the author, every week. If she does not answer, Jeanne calls back a quarter of an hour later, then the next day. After two absences, you are notified. A missed call is not lost: it is postponed.
- The clip is sent by e-mail or by text message with a link, on the evening of the call, after a member of the team has listened to it. If the author did not agree to a clip, you receive only the length of the call.
- The booklet (Book package) is sent at the halfway point. The large-print proof is sent to the author at the end of the calls, so that she can read everything through.
- The author's read-through comes first. Jeanne calls her to collect her corrections. Nothing is removed without her agreement.
- The family's read-through comes next, for ten days. Then a member of the team reads the whole and sends you a final approval request. Without a reply from you within fifteen days, the book is produced as it stands.
- Delivery of the PDF takes place in the family space. The hardback book is dispatched to the address given, within three working weeks of your final approval.
- The recordings are handed over to the family contact with the book, after her identity has been verified, without the passages the author asked to keep between her and Jeanne.
We commit to this process, not to a number of pages, a number of words, or a literary quality. The book is as rich as what the author chose to tell.
12. Who owns the book
The stories belong to the author. What she tells is her work. She keeps all rights to it. She can ask for a copy at any time, by telephone during a call or through the family, and she can listen to her recordings whenever she wishes.
The copies delivered belong to the family. The PDF file and the printed books you have paid for are yours. You can read them, give them, lend them, pass them round the family. You cannot exploit them commercially or publish them without the written agreement of the author or, after her death, of her heirs.
What is ours: the software, the method, the layout, the design and the brand. We claim no rights over the stories, the voices or the photographs. We never use the author's voice to create an artificial voice, nor her stories to train a model, nor for another customer, nor for our advertising without a separate written agreement.
The photographs remain the property of those who hold them. You authorise us to reproduce them in the book and in the family space, for this family only.
13. Duration, stopping and refunds
The contract begins when payment is confirmed and ends on delivery of the book and the recordings, or earlier in the cases below. The "Jeanne carries on" subscription is separate: it renews every month and stops on simple request, from the family space or by e-mail, before the next payment date.
You can stop at any time, without giving a reason, by e-mail or from the family space. The calls cease. You are refunded for the calls not made, pro rata: the price paid, divided by 24, multiplied by the number of calls remaining. The refund is made to the payment method used, within fourteen days.
The author can stop at any time, by telling Jeanne or by telling you. The refund is the same.
We may stop if the author no longer recognises Jeanne or the purpose of the calls, after talking it over with you; if the conditions in section 5 are not met; if the obligations in section 10 are not respected; or if the service risks harming the author. You are then refunded for the remaining calls, except in the event of serious breach on your part.
In the event of the author's death, the calls cease as soon as we are informed. We hand over to you what exists: recordings, transcripts, text as it stands. You are refunded for the remaining calls. We offer, at no extra cost, to compose the book from what has been collected, if that is your wish.
The printed book is not refunded once printing has been launched after your final approval, except in the case of a defect (section 15). The PDF, once delivered, is not refunded.
14. Right of withdrawal
You have fourteen days from payment to withdraw, without giving a reason (Articles L221-18 and following of the French Consumer Code).
If you ask for the calls to begin before the end of these fourteen days, which is the normal case since Jeanne picks up at the next time slot, you ask us expressly by ticking the box provided when ordering. You keep your right of withdrawal, but if you exercise it after calls have taken place, the price of those calls remains due, pro rata (Article L221-25). In practice, our rule in section 13 is more favourable: you can stop at any time, withdrawal or not, and you are refunded for the remaining calls.
The printed book is made to your instructions and personalised. The right of withdrawal does not apply to its manufacture once the final approval has been given (Article L221-28, 3°).
The PDF file is digital content. By asking for its delivery, you agree to lose your right of withdrawal on this file once delivered (Article L221-28, 13°).
To withdraw, send an e-mail to nissielthomas@avafirstai.com, or a letter to the address in section 1, stating your name, the author's first name, the date of the order and your decision. You may use the following template:

15. Guarantees and complaints
The printed book is covered by the legal guarantee of conformity (Articles L217-3 and following of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 and following of the French Civil Code). A book that is damaged, badly bound, badly printed or that does not match the final approval is reprinted at our expense.
The PDF file is covered by the legal guarantee of conformity for digital content (Articles L224-25-12 and following of the French Consumer Code).
An error in the text discovered after printing (a name, a date, a mistranscribed sentence) entitles you to a corrected reprint, free of charge, if it is reported within three months of delivery. An error that appeared in the final approval you validated, or that the author validated during her read-through, is not a defect; we correct it in the PDF all the same, and the reprint is then at cost price.

16. Liability
We are responsible for the proper performance of the service described in these terms.
We are not responsible:
- for what the author chooses to tell or to leave unsaid, nor for the accuracy of her memories. The book is her story, not an investigation;
- for the consequences of a wrong telephone number, an undeclared protective measure or false information given when signing up;
- for a health event occurring during or outside a call: the service is not a telecare service (section 4);
- for a failure of the telephone network, the author's operator or the internet, which are not attributable to us. The call is then postponed;
- for the use you or the relatives make of the book and the recordings after they are handed over, in particular with regard to the people mentioned;
- for a case of force majeure.
In every case where our liability is engaged, it is limited to the price paid for the order concerned, except in the event of gross negligence or personal injury.
We use providers (voice, telephony, hosting, printing). We remain your sole point of contact and answer to you for their work.
17. Personal data
We process data concerning you, the author and the relatives: identity, contact details, voice, life stories, photographs, payment. Some of this data is sensitive (health, religion, opinions), when the author mentions it spontaneously. The privacy policy describes everything: why, for how long, who has access, where it is hosted, and how to exercise your rights. It forms part of this contract.
In short: the data is hosted in the European Union, the recordings are deleted twelve months after the last call or sooner on request, what the author asks to keep between her and Jeanne is never written down or passed on, and we never use the voice or the stories for anything other than this family's book.
18. Consumer mediation
If you have a complaint, write to us first (section 15). If we have not found a solution together within two months, you may refer the matter free of charge to the consumer mediator we come under (Articles L611-1 and following, L612-1 and following of the French Consumer Code):

The mediator may only be approached if you have first sent us your complaint in writing, and within one year of that complaint.
19. Applicable law and disputes
These terms are governed by French law. They are written in French; in the event of translation, the French text prevails.
In the event of a dispute, and if mediation has not succeeded, the competent court is the one provided for by law. You may bring the matter, at your choice, before the court of the place where you lived at the time of the order or the court of the place where the harm occurred.
20. Changes
We may change these terms. The version that applies to your order is the one in force on the day you accepted it; we send you a copy with the order confirmation. A change made during the service that would reduce your rights is not enforceable against you. For the "Jeanne carries on" subscription, we notify you one month before any change, and you may cancel.
If a clause of these terms were held to be void, the others would continue to apply.
